I really wish I could remember whether it was possible to waive subject-matter jurisdiction. I guess not, or it wouldn't be heading to the USSC.

Thank you. It was late, I haven't dealt with civil procedure in 17 years.

Which means if the Court finds this is jurisdictional, poor Ms. Yarbaugh is SOL.
